Shortage & Damage Claim

Also searched as: shortage claim transport · damage claim transport · goods shortage in transit · transit loss claim

Direct Definition

A shortage or damage claim is a demand by the consignor or consignee that goods arrived short, damaged or lost. It is decided by comparing what was loaded with what was delivered, using the bilty, weighbridge slips, loading slip and the remarks on the proof of delivery.

Detailed Explanation & Statutory Rules

Most claims are won or lost on paper made at the time. At loading, note the count and the condition on the bilty. At unloading, the receiver should count and inspect before signing, and write the exact shortage or damage as a remark on the proof of delivery, for example "2 cartons short" or "3 bags torn". A clean POD signed without remarks makes a later claim hard.

For goods sold by weight, compare the net weight on the loading and unloading weighbridge slips; small differences are common because of different scales and moisture, so agree an allowed margin in the contract. The transporter's liability depends on the contract and, for common carriers, the Carriage by Road Act; goods insurance is a separate way to cover loss. Deductions agreed with the party are taken from the balance freight.

Legal Reference / Act: Carriage by Road Act, 2007 (liability of common carriers) and the terms of the contract of carriage. Limits and procedure depend on the contract and the facts.

Practical Indian Freight Example

"A truck loads 500 bags of sugar and the loading slip says 500. At unloading the consignee counts 497 and writes "3 bags short" on the POD before signing. The broker checks the weighbridge slips, confirms the shortage and deducts the agreed value of three bags from the balance freight."

Key Questions & Answers

How do I avoid a shortage dispute?

Count and note the condition at loading, keep the weighbridge slips, and make the receiver write any shortage on the POD before signing.

Who bears the loss if goods are damaged in transit?

It depends on the contract, the cause and whether the carrier is liable under the Carriage by Road Act. See owner's risk, and take advice for large claims.
